What is ‘freedom of speech’ and why is it important in our modern day society? Freedom of speech is the right, guaranteed by the first amendment to the U.S. Constitution, to express ideas and beliefs without unwarranted government restriction. Personally, i am for freedom of speech but hate speech shouldn’t be tolerated and people should keep hateful thoughts to theirself.

While attention is often, rightly, focused on the damaging impact discrimination or poverty can have on people’s lives, the impact such problems have on free expression is less rarely addressed.Why is access to freedom of expression important? Freedom of expression is a fundamental human right and The right to speak your mind freely on important issues in society is something that most people take for granted.Another major area where discrimination has a knock-on effect on freedom of speech would be the LGBT community (lesbian, gay, bisexual, transgender) people across the world.     There is a fine line in what is considered freedom of speech and what impedes on another person’s freedom. In fact John Stuart Mill states in his book On Liberty, “the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others” (1978, 9). The use of hate speech has a strong impact, especially in minority groups where the support system is not very strong.     Prior to the 1930’s speech was not as protected as it is today (Bell, 968). This is a freedom that many take for granted or spend very little time thinking about. While it would be easy to say that banning hate speech would clearly take away the freedom of speech, the truth is banning hate speech would actually provide opportunities for more people to enjoy free speech. According to Bell’s article in the Indiana Law Journal, minorities who are subjected to hate speech are more likely to avoid those situations whether it involves their place of work, home or public environment (966). They are not engaging in discussion like opponents of banning hate speech suggest, there is a clear understanding that this situation is not safe and must be avoided. While some would contend that hate speech is simply, spoken words that some find offensive, Stephen Newman, in Liberty, Community and Censorship, describes hate speech as words that heighten prejudice, and intimidate specific people (375). Even the Supreme Court does not always agree on the defining lines of hate speech. Erik Bleich in his article the Rise of Hate Speech lists several court cases that have helped to define the law in regards to hate speech. These cases include Chaplinsky V. The third section will be on what Altman might say to Rauch's opposite views. I will then discuss my view that hate speech should never be regulated under any circumstance especially in the name of protecting someone's psychology, feelings, or insecurities like Altman prescribes.
