Problem:
Two DOT Engineering Technicians were reported to have lied about their overtime timesheets usage and falsified safety inspections records. The City’s Auditor’s Office conducted a full investigation and provided me an overview of their findings. The purpose of this briefing is to review the Auditor’s findings on the two DOT Engineering Technicians, Tom Newton and Wayne Jones and provide recommendations for any disciplinary actions.
Background:
A whistle blower contacted the City’s Office of Employee Relations (OER) and filed a complaint to the OER Director about two DOT Engineering Technicians, Tom Newton and Wayne Jones. His report stated that Newton and Jones lied about the use of overtime on their timesheets and also falsified

    Lilly Ledbetter was one of the very few female supervisors at the Goodyear Tire & Rubber Co. plant in Gadsden, Alabama, and she worked at that plant for nineteen years, from 1979 till her retirement in 1998. Initially, when she started working for the company, her pay was equal to that of the other male supervisors. However, as time passed the pay discrepancy between Ledbetter and her 15 male counterparts was stark: the lowest she received was $3,727 per month, while the lowest paid male received $4,286. Thus, after realizing this Mrs. Ledbetter filed an official complaint before the EEOC in March 1998, stating that Goodyear violated the Title VII as they paid her a discriminatory low salary due to her sex. After she filed an official complaint, her case went to trial, and the jury concluded that the pay disparity was due to intentional discrimination. However, the Court of Appeals for the Eleventh Circuit reversed the jury verdict, as it claimed Mrs. Ledbetter’s’ case was not filed in time, as the original discriminatory pay decision occurred before the statutory limitations of 180 days.…

    A truck drive was discharged for failing to make timely deliveries and not using the quickest, most direct route as previously instructed. The company warehouses and distributes wholesale floor covering products and operates from several locations. The driver was hired in November 2000 and during his relatively short, eight-month tenure with the company received a total of four other employee warning reports. According to the employer, the driver demonstrated a continuing pattern of failing to follow orders, company policies, and supervisory instructions involving the use of a global positioning system (GPS) mounted in his truck, completing daily driving logs, and utilizing toll roads for the best way to make deliveries in a timely fashion. On two occasions the employee simple failed to complete his deliveries, costing the company extra expense and a loss of customer satisfaction. The triggering even for his termination was his refusal to use the toll road to make a delivery even though he was offered an advance of the toll road fee. In response, the union claims that the employee’s failure to use toll road was justified because he was already owed $87.32 in post-toll reimbursements. One of the employee’s prior warning reports was grieved and settled in his favor, and he was disputing the remaining three at the time of his discharge.
