The main provisions of statutory requirements for the employment relationship, discrimination at work and fair employment.
The main legislation is the Equality act 2010 and replaced other legislation in place such as Race relations and disability discrimination acts etc.
Under the Act, people are not allowed to discriminate, harass (bully) or victimise another person.
Discrimination (Direct, indirect, by association, and by perception) - A person is treated less favourably than another person because of a protected characteristic, or associate with another person who has a protected characteristic, others think they have a protected characteristic.
Eg Direct discrimination – A woman is refused employment on an oil rig as a driller because she was a woman and was too small.
Discrimination by association – A person does not get a promotion, after disclosing that they are looking after a relative who has just had a debilitating illness. This discrimination is due to association with a disabled person (protected characteristic)
Discrimination by perception – A person does not get a job applied for as he is badly limping at the interview due to an injury at home and the employers believed that he was disabled and would struggle on his feet all day due to his disability they saw as permanent.
Indirect discrimination – This is when a rule or policy that applies to everyone, but disadvantages a certain group with a protected characteristic, unless is can be proven it is for valid reasons. Ie No beards for
