Part B – HRTC – E-Commerce Weekly
1.) Unfortunately, even though the visitor entered the website and click subscribe, they did enter an enforceable contract to pay for the subscription. In order for this to be an enforceable contract, the visitor would need to subscribe. Typically, when you are required to agree to terms and agreement, this is stated in the area where you complete the purchase. It is the visitor’s responsibility to actually read the agreement before deciding to subscribe. This is actually one of the problems with cyber agreements. Acceptance to the agreement could be done intentionally or accidentally but unfortunately, the visitor is still responsible for anything stated in the agreement.
2.) HRTC did not commit any crime in this situation. They offered the agreement that the visitor has the option of reviewing. They provide the information that a person would be concerned about when agreeing to a subscription. It is not HRTC’s responsibility to assure that the visitor actually reads the information. The visitor had the option of referring to the agreement, and opting out of the financial responsibility that they would owe, but instead decided to subscribe without making themselves aware of their portion of the agreement.
