Judge Trump Case Analysis
In terms of a practical association, President Trump officially signed the executive order claiming that the U.S. will be if Muslims and immigrants were prevented from entering the U.S. The utmost strategy to prevail in attaining positive effects are questionable, which could lead the U.S. into turmoil or increase the power that the U.S. currently upholds. According to the article, President Trump was convinced that this executive order will prevent “evil” from entering the U.S. Although this executive order was created with the aspect to protect the U.S., several politicians including Republican senators have questioned the reliance of this contract. Once the executive order was made official, several legal aliens who arrived in the U.S. were …show more content…
Robart. Judge Robart’s viewpoints are strong and liberal, for which he believes that keeping refugees and immigrants away will not prevent the safety of U.S. citizens. President Trump believes that using force will help make the nation better again, which makes him more of an aggressive leader. On the other hand, Judge Robart believes that immigrants and refugees should not be forced to leave the U.S. unless they perform any dangerous acts, which is an example of a democratic leader. In my opinion, President Trump is rashly performing his duties one-sidedly because he has the authority to legalize the contracts he sees fit for the U.S. This is an example of excessively using the power bestowed upon him.
From a logical standpoint, the executive order is the start to causing conflicts between other nations. Several refugees and immigrant citizens are powerless against higher authority individuals, which amplifies the role of government officials. The executive order is also an example of power and authority because everyone must oblige to the rules once it is made official. From viewing the article, it indicates that having power and the authority to make decisions is limited even when that person with power is the president of the

Scalia was born in New Jersey but later moved to Queens in New York (Reilly, 2016). Scalia’s parents were both teachers, which may have been why he was valedictorian when graduating from St. Francis Xavier high school. After high school, he went to Georgetown University, where he also graduated at the top of his class, achieving the honor of valedictorian yet again (Reilly, 2016). Scalia got his bachelor’s degree in history, but wanted to further his education, so he went on to Harvard Law School, where he graduated again as valedictorian of his class in 1960 (Reilly, 2016). After graduating from Harvard Law, Scalia worked in a private practice for just a couple of years, only to discover he would rather be teaching as a law professor at a University, which is what he ended up doing.…

The Dred Scott Supreme Court decision is an embarrassment in American history. Before the the case was brought to the court Dred Scott,an enslaved African American, tried to buy his freedom for $300 but the offer was declined. He finally went to the court to see if his freedom could be granted through the legal system. However he lost on a technicality because he could not provide sufficient proof that he was owned by Emerson’s widow. In 1850 there was a retrial in the Missouri supreme court, which granted them freedom. However two years later the Supreme court stepped in and reversed that ruling. He finally appealed to the United States Supreme Court, which ruled that because he was black he was not a citizen, in effect he restricted, or…

The current immigration policy is seriously treated as a national security issue due to the rise of illegal immigration, drugs smuggling, and terrorism in recent years (Andreas, 2009). Preventing another 9/11 has been at the top of the agenda in all recent presidential administrations, which has made the immigration policy to fall around this issue by creating new anti-terrorism programs and initiatives that restricts the admission of person into the United States (Andreas, 2009). Before 9/11 immigration in the United States was a “Low Politics” issue meaning that it was not a top priority for presidents, government and state officials (Andreas, 2009). During that time the United States and Mexican border was just a mangle chain like fence with no border patrol officers and anybody could leave and enter the U.S. as they pleased without going through any border searches (Andreas, 2009). After 9/11 the issue of immigration went from “Low Politics” to “High Politics” to the extent that many presidential campaigns have run promising that immigration will be one…

Gustavo Garcia said, “I am glad I was able to tell the Supreme Court justices that they were a little confused in thinking that we are all wetbacks”. I remember the first time I heard the term, wetback. I was young, twelve years old in the sixth grade. I had gone to this elementary since kindergarten, and had the same classmates too. We were all friends, but as we got older we began to break into cliques. It did not seem like a big deal, we still talked to each other every now in then. One day while on recess I heard there was a fight. Soon I found out my brother and his friends were involved. The fight began over something innocent, but quickly became ugly when the other group of boys called my brother and his friends, dirty wetbacks. All…

Executive orders enable the President of the United States of America to enact a pseudo-law without the need of approval from Congress. Some presidents make more use of them than others. For example, President Franklin D. Roosevelt, in the early 30's, took the most advantage of them due to the Great Depression. Similar to FDR, President Trump is making the most of his privilege in the White House, but in contrast to FDR's helping initiative, one of President Trump's executive orders were instituted on a discriminatory basis that benefits his many business ties.…

The case law to date does not clearly provide any legal limits on the President’s use of authority when placing prohibitions on the entrances of immigrants into America. The Act provides very broad authority as to how the president of the United States may do so. When read carefully, the Act clearly does not authorize the president to prevent immigration based on country of origin, nevertheless, it does authorize the president's decision of preventing the immigration of aliens based on his stance. For example, the president shall have the power to place temporary restrictions on immigration based on country of origin if he deems that the well-being of the United States could be adversely affected by any immigrant or any foreign country. However, he is not recommended, nor is he permitted, to prohibit any alien or class of aliens from immigrating to the United States based on factors that include bias’ along with sex, income, and religious…
