Mulroy V. Feli Murder Case
On Monday February 29, the custodial staff at the Middle School Building at St. George’s Independent School called the police station to state that they had found a dead body lying face down in the office of room M223. There was no evident cause of death: no obvious trauma, no gunshot wounds, no puncture wounds, but blood was found on and around the body. There were cups of dr. pepper and a sticky note pad along with some other evidence found on the crime scene. An officer interviewed the Middle School Director, Mrs. Lori Williamson, and was informed that Felix Navidad was hired to evaluate the efficiency and productivity of the seventh grade faculty. He would make recommendations for salary adjustments and staffing decisions. I believe that Tara Mae Mulroy should be charged with the murder of …show more content…
They could try and state that she did not poison Mr. Navidad because she was not the only one that had the opportunity. We used her surveillance footage times being off as a point of her lying. They could say she just forgot the exact times. They could say she was just in the wrong place at the wrong time. Her fingerprints were not at the crime scene. Ms. Brown’s hair was found there o why not accuse her of the murder. Even though the defense team might have had some arguments I can fight back and respond to all of them. We did a forensic test to prove that only Mrs. Mulroy could have poisoned him because she was the only one that had the opportunity to have put the poison in the cola. The test came back negative on the ice cubes so that ruled out Ms. Brown. Yes she could have forgotten but she left out major points in her interrogation trying to throw us off. She had a motive to kill him. She did have a meeting with him to give her an opportunity to kill him like she had planned. We did not run a DNA test to prove that any kind of hair material or DNA found. That is her office so of course her hair is in her

    These cases appeared some thirty years ago but set the stage for government intervention and laws to protect teachers. It also set a precedent in the procedures regulating substitutes and the hiring process. In a Michigan case an elementary school student was injured playing "kill" at recess under the supervision of a substitute teacher. It was common practice in the school for the game to be played and the principal was aware of its use. The student filed suit naming the absent teacher, the principal and the school district as defendants. The court felt that the use of the game was inappropriate and constituted negligence. (Cook v. Bennett, 1979) In determining the liability of the regular classroom teacher, the court noted that the "threshold element of a negligence case is that there must exist a duty. . . . "(Cook v. Bennett, at 610) Although the teacher owed a duty to exercise reasonable care over students in his charge, this duty "is coterminus with the teacher's presence at school. Supervision implies oversight. In order to oversee student activity, a teacher must be present to observe and control." (Cook v. Bennett, at 610) The court found that the regular teacher, by not being present at the school owed no duty to supervise his pupils and was therefore, not liable. The school district, though normally liable for the negligence of its employees, was protected by governmental immunity by Michigan law. In contrast, the court ruled that the supervisory function of the principal was ministerial in nature and not protected by immunity. The principal enhanced the likelihood of the injury by failing to properly supervise the teacher and by failing to establish rules and guidelines for the safety of the pupils. Thus she was found…
