As a judge I have ruled the Affordable Care Act, better known as Obama Care, unconstitutional. Not only does the act go against the constitution, but it also has a negative impact on the people of our country. Obama Care goes against the amendments, violates laws and prior rulings, and makes the American people pay higher taxes. Overall, the Affordable Care Act is unsuitable for the United States. Obama Care is unconstitutional. It goes against the first amendment as well, the contract law, and the ruling of the Gibbons v. Ogden case. The first amendment prohibits any laws that threaten freedom of religion. For example, buying health insurance is against the Muslim faith. Furthermore, Obama Care is threatening freedom of religion by forcing citizens to go against what they believe in and buying health care. Next is the contract law. According to the contract law, consent must be informed and must not be coerced. Under Obama Care, the government will force individuals to go into contract with insurance companies with the threat of penalty. Therefore because the Affordable Care Act coerces people to buy health insurance with the threat of a fine instead of just informing them of it, the act also goes against the contract law. Lastly, the court has previously ruled in the Gibbons v. Ogden case that health care can not be run by the states. This is precisely what Obama Care does. That is the main reason that I have ruled Obama Care unconstitutional. There are many other reasons why the Affordable Care Act harms our country. It creates higher taxes, proves to be unfair for others to pay for those who can not afford it, and worst of all sets a precedent for our government. If our government can force the people to buy health insurance, where will the line be crossed? The government could force the people to buy anything with no repercussion.
