Online Environment and the Law Essay

In this assignment, I have put together two separate discussions. I will start by discussing ways that anti-trust laws may place too much burden on commerce in the global market. The second part of my paper will explore reasons why discount real estate brokers cannot create their own websites. I will also give example as needed throughout the paper.
Anti-trust Laws The first burden that anti-trust laws place on commerce in the global marketplace is established when trying to revise the trade laws to make them consistent with the competition protection principles of antitrust. Increased openness of the U.S. economy makes foreign firms who export to the U.S. additional competitors in many U.S. markets. Foreign export competition is not always sufficiently strong or reliable that we can abandon antitrust enforcement against domestic price fixing or mergers. The enforcement activity taking place around the world raises the question of how much harmonization can be achieved among diverse nations' antitrust programs (Neimann, B. 1995) A second burden is that it is unclear whether competition policy is a sensible role for government in developing, particularly low-income countries. In these countries the markets are usually very small and fragmented.

In this article, the main topic is online business. It explains the importance of e-business and how vital it is to have adequate laws that protect the business. These laws should be used and known worldwide, since any individual can make a purchase from anywhere in the world (different places, different laws). This article uses e-business in Mexico as a perfect example. E-business is at an early stage in Mexico, which means no specific laws pertain to e-business. E-business is not mentioned anywhere in Mexican laws or regulations, making it difficult to validate any enforcement. Mexico is currently in the process of drafting and putting together laws and regulations pertaining to e-business.…

Antitrust laws are federal and state government laws that regulate the conduct and organization or businesses. This helps promote fair competition for consumers. There are four main areas involving the antitrust laws that include agreements between competitors, contractual agreements between sellers and buyers, the restriction and maintenance of monopoly, and mergers. The Sherman Act, which is one of the main statutes, has a contract or agreement in the form of a trust, dealing with trade and commerce among numerous of states, or nations, is deemed illegal. Also, it states that any person who monopolize, or attempt to, conspire with any other person(s) to monopolize in trade commerce will be found guilty and charged with a felony. Both of these violations carry major penalties. For each corporation that violates the act may be fined up to $1 million. Likewise, any persons found guilty of a violation may be fined up to $100, 000 and/or imprisonment for up to three years. For corporations, it is hard to enforce this law due to lack of identification of a specific market to prove monopolization. It requires scrutiny of both the market and the product from the vantage point of both the consumer and other potential producers (Ecnomicae). The Clayton Antitrust Act added to the already existing antitrust law by forbidding things like price discrimination, “where the effect of numerous practices may be to drastically decrease competition or…
