Five members of the court ruled that the President military tribunals violated military law and the Geneva Conventions. The court declared that Congress had to require the tribunals to adhere to the law of war (Cole, D. 2006). The administration insisted that the rule did not apply to the conflict with Al Qaeda because this was an international conflict. But the court rejected that interpretation because Al Qaeda is not a nation and is covered by the Article 3 (Cole, D. 2006).
