00199.10 Procedure for Resolving Disagreements - When disagreements arise between the agency and contractor concerning additional compensation and or additional contract time and compensation, the contractor will first attempt to come to a resolution through the Engineer of all the issues. If a satisfactory resolution cannot be reached between the contractor and engineer, the contractor will follow the protest procedures in 00199.20.
00199.20 Protest Procedure – If a contractor disagrees with work required in a change order or other written or spoken order from the engineer in the contractor’s opinion entitles or would entitle the contractor to additional compensation, the contract will complete all of the following to pursue a protest and preserve it claim. The contractor is required to give oral notice of protest to the engineer, file written notice of protest with the engineer within seven days after receiving the protest order. …show more content…
At any time during the of the project, but not later than 15 calendar days following the date of the second notification, the contractor will submit to the engineer claims for additional compensation or additional combination of compensation and contract time to the specified contract. For claims to be considered the contractor must submit an executive summary; copies of contract specification that support the contractor’s claim, theory of entitlement, itemized list of claim amounts, additional contract time request, and actual expense
