supported by a probable cause. In addition phone records fall under the Fourth Amendment. Therefore without a probable proven the police or another citizen will not be legally allowed to look at your personal phone records. Electronics such as computer, the Fourth Amendment applies to the Internet (Legal Information). Due to the Fourth Amendment citizen’s privacy is protected. Furthermore of the Fourth Amendment protecting citizen’s privacy, it also makes citizens feel secure.
Involvement of the Fourth Amendment in the United States makes citizens feel secure. “Warrantless searches and seizures are presumed to be unreasonable,” which results in people feeling secure. If a citizen were to be searched they could only be searched if the police officer must show their authority. Handcuffs, weapons, or the use of forceful language are all indicators a police officer would use to show authority (Legal Information). Which does make people feel secure because there is another step for a police officer to search a citizen in the United States. They are more comfortable to drive their car and do daily life things. Which includes if a citizen were to have any type of evidence according to the law. While Fourth Amendment makes people feel secure, it also prevents searches. The biggest benefit of the Fourth Amendment is that it deters searches. A search under the Fourth Amendment is “when a governmental employee or an agent of the government violates an individual's reasonable expectation of privacy” (Legal Information). If the government were to invade a citizen’s property no law enforcement shall search the human, but upon probable cause. The court will be the one to tell if the search falls under the Fourth Amendment, if it were to fall under the Fourth Amendment the citizen would not be searched. In addition, when the law enforcement believes searching a citizen is reasonable, no excessive force shall be used. Electronic surveillance is also under the Fourth Amendment, so the law enforcement cannot watch you with any type of electronics of any sort. Furthermore, your personal items: backpack, house, or phone are considered your property so the law enforcement can search any of them without the citizen’s permission or proved as reasonable. Although of all of the advantages of the Fourth Amendment, a disadvantage is that for the law enforcement it makes accumulating evidence harder. Some may argue that the Fourth Amendment makes gathering evidence more difficult for the law enforcement.
The Fourth Amendment’s ultimate goal is the “provision is to protect people’s right to privacy and freedom from arbitrary governmental intrusions” (Legal Information). Therefore the Fourth Amendment gives everyone a right to their own privacy. Even though that it might seem like it would make it harder to gather information. The Fourth Amendment is "the right of the people to be secure in their persons.” In addition, the law enforcement only needs to be “supported by a probable cause” or an “arrest warrant,” to search a United States citizen. Although, the police officer could arrest a suspect to stop them from running away or to preserve evidence. Besides the Fourth Amendment is still beneficial for all United States
citizens. Although the Fourth Amendment may be aggravating for the police, it is beneficial for United States citizens. The 4th Amendment preserves protection, makes citizens feel secure, and prohibits searches. Without the involvement of the Fourth Amendment in the United States, government or authorities could invade privacy and go through citizen’s belongings without any type of consent.
