Charlotte City Council filed a case to ensure that visitors, workers, and residents will not be discriminated from any aspect. Governor McCrory signed House Bill 2 that blocked the local governments from passing act with nondiscrimination defending for the LGBT citizens and needs transgender citizens to use bathrooms and locker rooms that align with their biological sex. Based on the case, the Charlotte City Council approved the suggested amendments to the city’s Nondiscrimination Ordinances on February 22, 2016. The amendments added family status, gender expression, sexual orientation, gender identity, and marital status to the list of the protected traits in the previous Nondiscrimination Ordinances. However, the Nondiscrimination…
This is hard case to deal with because there are not many laws that will protect the LGBT group. There are tricky ways in which the law can be walked around it. In this case of homosexual discrimination the law looked on the discrimination part, but they took a turn where they made it seem as if the Boys Scout organization was having their right of free expression and association violated and this made them get out of the trouble they were in before. After doing this research I have learned more about the LGBT society and the amount of discrimination they are going through. More than that I am surprised how can the law be manipulated to make it seem as if the LGBT society is not being discriminated but organizations have the right to decide who do they let in or not without considering the person. This is extremely hard to analyze but I am glad that I took a chance to go in depth and draw my own conclusions and learn how laws are put in…
Nicole Maine a fifth-grader transgender student together with the Maine Human Rights Commission sued the Oronos’s school district in 2009 after she was forced to use the staff restroom instead of the girl’s bathroom. According to the article, the Supreme Court of Maine ruled in favor of the student, due to the school violating the “Maine Humans Rights Act’s which bans discrimination based on sexual orientation or gender identity “(The Mercury News, 2016). The article also mentions a very important detail regarding the ruling of this case and that is that prior to this case no state high court had ever established that a transgender person has the right to use the bathroom which they feel identifies their gender (The Mercury News, 2016).…
The Lesbian Gay Bisexual and Transgender (LGBT) community has faced discrimination throughout history, 2015 is no exception. LGBT people are being denied their unalienable rights, one of these rights is marriage.…
Analyze one of the characters in Sunset Boulevard. Think about their femininity/masculinity/gender by using essays on queer gender relations in Gender Outlaws: The Next Generation. How does Sunset Boulevard connect with Hollywood, je t’aime? Use detailed examples, and make a clear argument based on close analysis of Gender Outlaws and the films’ formal features.…
Dean Spade outlines the difficulties trans-gendered individuals have in advocating for their rights to safe spaces and gender inclusive policies. As most trans-gendered people experience some form of abuse and/or trauma, and are unwelcome in many high schools and street outreach programs, their disenfranchisement often turns into a vicious cycle of poverty. Although trans-gendered individuals are part of the LGBT community, there is a strong bias of LGBT political movements towards the empowerment of the wealthy gay individuals, and in turn the oppression of lower class trans-gendered community.…
In 2017 one year later under the Trump Administration, the guideline reversed and now leaves educations unsure about transgender student’s rights under the law (“Title IX,”2018). Though Title IX may have had some pros and cons throughout the years, overall it had made a great and positive impact on society as a…
Having done this research, I understand that gender neutral bathrooms are desired and should be legal everywhere in the United States and around the world. According to Heartland Trans Wellness Group, places with multiple person gender neutral bathrooms report no complaints, no harassment, and no violence (Yokoyama). The safety of a gender neutral restroom actually does not depend on the use of different genders in the same restroom, but instead depends on the consciousness of people regardless of gender. The idea of switching to or adding gender neutral public bathrooms might feel strange to an amount of people at first; but these changes will go a long way toward improving the lives, health and safety of transgender individuals. Transgender people have the rights to feel comfortable using public restrooms. As I end my exploratory essay, I want to say that we all are created equal. However, some of us have less equality of opportunity than others. It’s time to make a…
Members from the LGBT community are protesting over this “new racism”. Transgender men and women want to be able to use any bathroom they like and if they can’t, they want to have same sex restrooms. Many would argue this is a convoluted subject that no one can’t really determine what is right or wrong. A question to consider for same sex restrooms is, why is the comfort of people in public restrooms privileged over others? While people from the opposing side are question the rape of women and children because a minority of people want to feel comfortable in non-gender…
Although in recent years great progress has been made for LGBT+ students, schools across America still have not eliminated transphobia, nor are they making strong enough efforts to be inclusive to transgender students. Discrimination within bureaucracy, faculty, and students still runs rampant. There is not good enough health education for trans students, there are not enough policies in place to make sure their identities are respected, and there is not enough support in terms of facilities or resources to make trans students comfortable. Trans children need a safe environment, and schools are not currently providing one. Transgender youths are at higher risk for both homicide and suicide, and making sure…
It’s difficult to choose which type of discrimination needs the most immediate attention, especially on a world scale, as there are so many forms of prejudice and many I am unaware of .With the ones I do know about it’s difficult to choose the one that creates the most harm. Is the discrimination against women the most damaging as they are a significant part of our population? Should we address the violence against them and the economic and social repression? Should we address the strain of nationalism and anti-immigrant rhetoric that is abundant in countries like the U.S and Britain? Should we address the discrimination against people of the Islāmic faith or those of the LGBTQ community?…
I recently read a newspaper article about “Job” the news article was about good and evil of man. The author Salley Vickers(2010) stated that the Bible “combines lyrical beauty with a modern nihilism.” In the story of Job, there is conversation going on between the Lord and Satan. The Lord asks Satan where he was going and he says to and fore seeing who I can devour. The Lord asks Satan had he consider his servant Job. Job was a good man never did anything evil. Satan told the Lord if he would take the fence from around him that he could make him sin. The Lord agreed to take the protection form around Job. Job suffers a great many mishaps he loses his wealth, children all die and body become cover in sores. His friends accuse Job of sinning because he was in God favor and now is suffering. The irony of this story is that Job never sin and he was a good man. I would say that the good that Job receives was through the Lord which reflected on to him making him a good person through God giving. But the evil that was reflected on him was by Satan. Sometimes I think that people are either good or evil it is the circumstances surrounding them in which they can appear good or…
In 2010 41% of transgender Americans attempted suicide. 19% of transgender people report being refused medical care and 2% have been violently assaulted in a Dr.'s office. These shocking statistics are from the United Sates. The place that's known to be a melting pot; where every person whether they're black, white, purple, orange, or just plain weird - is treated equally. We have allowed this to happen to our country. How could we be so cruel, heartless, and unsympathetic? Where did our understanding go? The understanding that allowed freedom of speech, freedom of religion, and the billion other things that founded this once beautiful country. Put simply, this ongoing transgender battle leaves human beings feeling less than others and abused;…
Fricke v. Lynch was a court case in Rhode Island. Aaron Fricke was prevented from bringing his same-sex date to prom by his principal (Richard Lynch). He prevented him from bringing his date because he felt that the students would not approve. He felt that Fricke and his date would be harmed. The court ruled that students should not be prevented from participating in school events that are lesbian, gay, bisexual, and transgender (LGBT). The staff was also told to protect the students from harassment. Even though the principal made his decision out of safety reason you cannot ban students from participating in events because their sexual orientation is with the people of same-sex. Still today schools around the world still have teens being harassed for being a homosexual.…
These rights include Title XI, which in Hinckley’s article it states “the Department of Justice defines as "a comprehensive federal law that prohibits discrimination on the basis of sex in any federally funded education program or activity””. Owing to this violation there was a lawsuit from a sixteen year-old boy Gavin Grimm. Gavin was by a Virginia school board by banning him from using the boys’ restroom. Gavin did end up winning the case he states he “didn’t set out to make waves” what set out for was to “use the bathroom”(Hinckley). In an article written by Kristen Schilt titled “Bathroom Battlegrounds and Penis Panics” Kristen states “Opponents of transgender recognition often brought up the specter of sexual predators in sex-segregated spaces as an argument against the passage of transgender rights legislation.”(27) Some believe predators can use the excuse of transgender people to use the proper bathroom as an ok to enter. Again being transgender isn’t about he sex its about the gender. The law in North Carolina has also brought up boycotts because of the…
