So far, Bill 168 Occupational Health and Safety Amendment Act (Violence and Harassment in the workplace 2009, which took effect from June 15, 2010; requires that employers have to include in their organization policies, procedures and training which help to identify the psychosocial hazards caused by harassment and workplace violence.
The question about if Does Bill 168 go far enough to protect employees and is there a limit to an organizations involvement and/or obligation considering domestic disputes that are “outside” the workplace?.
It can lead to different point of view. My personal point of view is that never legislation will be enough to protect a person. While people don 't take the active participation of fighting against violence, the human being could never be totally protected.
Bill 168 is a very exceptional example in how a pure legislation can develop a worker protection. It means that bill 168 is going far enough to try to protect the employee. And, there are not limit to an organizations involvement and the obligation to consider the domestic or home disputes as a part of the workplace hazard.
The workplace is considered our second home. Most of our time is expended in our workplace. Who will be a person that can observe our behaviour in case of suffering domestic violence? They are ours co-workers or managers.
The Bill was very precise in including the obligation of the employer to deal with this kind of hazard. The employer has the obligation to implement programs that secure an environment free of workplace harassment and psychosocial hazards.
