Employers must understand that the persons who evaluate and decide the outcome of employment discrimination cases (the EEOC investigator, federal or state judge, and/or jury) have keen senses of fairness and expect that employees will be treated in a fair manner. As a result, employers are exposed to substantial liability for any acts, including perceived acts, of discrimination in the workplace. Employers should take any charge of discrimination seriously and the employer must keep in mind that, at a minimum, it needs to have a legitimate, non-discriminatory reason for taking the action in question. In addition, an employer's response will be evaluated by persons who have a different perspective than the employer. What…

(2006). Workplace harassment: double jeopardy for minority women. Journal of Applied Psychology, 91(2), 426-436. DOI:10.1037/0021-9010.91.2.426 Women in the workplace, especially minority women, have had many more incidents with being harassed at work. Minority women call it a “double jeopardy” because they are harassed based on being a woman and being a minority, which both come with prejudice. Not only is being a minority woman an issue with harassment, but they are also paid much lower than even just a white woman. The research has four hypotheses; the first being that minority women are harassed more in the workplace, and the second being that there is no relationship between a minority woman and the amount of harassment that they face in the workplace. The third hypothesis is that minority woman, as opposed to white women, are harassed more, and the fourth is that women in general are harassed more in the workplace. The study done in this research was a survey that was sent out to 800 people of different male-dominated and female-dominated corporations. The survey measured different types of harassment, as in sexual, ethnic, and overall. One of the main control variables in this study was the dominant sex of the company. As a result, almost half of the responders reported having been harassed in the workplace, whether ethnically or sexually. Some limitations to this research study could have been the amount of people that they…
There are many forms of discrimination still present in the modern day world. Many of these instances take place during the daily operations of business. The objective of this paper is to highlight the concept of affirmative action in the workplace, and explain why one person of gender or race would be hired over another more qualified for the position just to fulfill hiring requirements, while using Kantian and Utilitarian ethical theories to justify each side of the issue.…
There are many people such as Jamilah Decosta who have been discriminated because of their race. Jamilah Decosta, an African American woman, attempted to obtain a job at a bakery in New York as a counter girl. She was denied the job because the co-owner believed Jamilah would scare away customers because her skin color. She then notified the Human Rights Commision. In the three years the bakery had been in buisness they discovered that not a single African American or man has worked the counter. As a result, the Human Rights Commision required the bakery to pay $25,000 due to a discrimination penalty. $10,000 of it was given to Jamilah.…
Today’s organizations are faced with many ethical and legal issues when dealing with the diverse work force such as the potential of discrimination when conducting day-to-day activities. The issues of diversity and discrimination affect many organizations behavior when considering how to properly treat the employees without making decisions based on based on race, nationality, creed, color, age, sex or sexual orientation. The influence of laws on decision-making has a direct impact on the livelihood of an organization. Understanding laws about discrimination is important if one wishes to be sure he or she is being treated fairly. This paper will discuss the legal process one would pursue whom was discriminated against by a private sector organization and wishes to file a complaint. The factious employee’s name is John and he wants to file a complaint against his employer for discrimination. This paper will describe discrimination laws and show how a complaint begins with the Equal Employment Opportunity Commission (EEOC) and proceeds through the civil litigation process from the state level up to the United States Supreme Court.…
Employment discrimination and harassment occurs in the workplace for a variety of reasons. The Civil Rights Act of 1964 identified race, sex, religion, and national origin as discrimination criteria. This paper will address those issues covered under the Civil Rights Act. When making an assessment concerning employment discrimination or harassment for any legal action, it is important to review the relevant legal standards and procedures.…
People have the opportunity to get good jobs but other have to leave their job to do racist problems some company’s judge the people by there appearances or the way the look or even the clothes they’re wearing. Is not the first time we experience segregation in America and it connected to gentrification because the cities are pushing the color or the Latin people out to make a better…
Although people have skills and well-educated, they are still facing the barrier of racial discrimination. The roles of discrimination plays in African Americans and other minorities in the job market are serious. For example, John Hudson’s brother faced discrimination issue at his workplace and being fired without a valid reason. In Rank’s book, Chasing the American Dream, John Hudson concedes, “So the point is my brother worked hard, he wanted to be an electrician. But because somebody was in a position, a supervisor, he discriminated against my brother. Maybe because my brother is a dark skin African American, and I’m light skinned. He didn’t like him” (qtd. in Rank et al. 121). This shows that John’s brother was being discriminated at workplace…
In order to keep discrimination out of the workplace, it is necessary to enforce the law on both the employer and employees. Everyone deserves equal rights. Even though some types of discrimination goes unnoticed, it should still be brought up and addresses. No employer should judge someone because of how they look, how their name is spelt, and how they sound when they speak. Women should not be denied equal rights, when it comes down to applying for the same job a man is trying to get.…
In an ideal world, every person is treated equally when it comes to getting a job, advancing in their career, and being treated fairly in the workplace. However in reality, we know this is not the case. Racial discrimination does still exist in hiring, firing, and promotions and unfortunately discrimination against Hispanics in the workplace is on the rise. As the economy worsens and job losses mount in America, there is an increase in discrimination toward Hispanics in the workplace in America. Racial discrimination poses a large problem in the American workplace. Racial discrimination affects people all over the world. In defining racial discrimination, the National Research Council differentiates between differential treatment and differential effects, creating a two-part definition: one being differential treatment on the basis of race that disadvantages a racial group and two being treatment on the basis of inadequately justified factors other than race that disadvantages a racial group with a differential effect (NRC, 2004:39-40). People of all ethnicities and from all different walks of life are influenced in some way by workplace discrimination which is the most common form of discrimination. While America has always stood for being a country with diverse ethnic cultures that make us great, the fear is that those who have the least may suffer the most in this economic downturn as unemployment rises and jobs, even those that were previously unwanted, now become a precious commodity. While African-Americans in this country have for many decades, always suffered the most unemployment, Hispanics are…
In the 1920’s, restaurants in the United States were not the same as the restaurants we visit today. Certainly there were servers to serve food and beverages expecting a tip as usual, but that is not what is different. Look toward the window, there is a sign written in big letters: WHITES ONLY AT THIS POINT. During this time, signs granting access to whites were common, but what does this mean for the races that are not white? Whether one can admit it or say otherwise, racial discrimination will always be part of modern society. The world has faced the issues of discrimination ever since the beginning of time. Discrimination can be defined as the prejudicial treatment based off of different categories. These different categories apply to religion, race, sexuality and gender. Since the earth was formed, the world has been brought up by race. After the discovery of race, the issues of discrimination start. An example of this is with the settlers of Europe. They looked down upon Native Americans as inferior to them. The Natives have been beaten and raped and forced to convert to Christianity by the force of Europeans. Still to this day we still struggle on the topic of discrimination. As mentioned earlier racial discrimination still exists, but we fail to realize that it is happening. Many people believe that discrimination has gotten better, but is it really? In the media, we hear reports about the treatment of minorities in the law. One race can be turned away for job even if they are more than qualified for the position. This paper will argue out of all minorities that experience discrimination, African-Americans experience it the worst. This paper will also explain that although individual discrimination is at a minimum, institutionalized discrimination still exists at an all-time high but…
Discrimination has been a major social issue for as long as time, with the changing landscape of race and ethnicity in the U.S. manifesting discrimination in different ways over time. In an incredibly diverse society racial discrimination is prevalent and has greater damages and implications than many imagine. Racism is defined as a set of attitudes, beliefs, and practices used to justify the superior treatment of one racial or ethnic group and the inferior treatment of another racial or ethnic group. Racism is always accompanied by prejudice, a negative attitude based on faulty generalizations about members of selected racial and ethnic groups (p. 53). Racism and prejudice are the ideological basis for discrimination. Discrimination is more…
In Hegewisch and Hartmann’s article they say, “sex and race discrimination in the workplace shows that outright discrimination in pay, hiring, or promotions continues to be significant feature of working life” Clarifying that men and women are being organized by their sex and color, discrimination was supposedly over a long time ago but that is a lie. For example there is a group a people and a judge. The judge will tell people what he thinks they are; a dark man is called forward and told he was a thug, a Chinese is called forward and told she was a doctor, a talk white man is called forward and told he was a construction worker, and last a white woman is called forward and told she was a receptionist. When really these people were nothing that they were told; the dark man was a cop, the Chinese woman was librarian, the tall white man was a veterinarian, and the white woman was a big business…
Unfair treatment approaches in different forms. Not only do Black Americans face discrimination in the workplace, they receive it almost anywhere they go. “Roughly half of blacks (47%) say that in the past 12 months someone has acted as if they were suspicious of them because of their race or ethnicity.” (On Views, 2016, June 27.) This quote explains how black people feel about others actions. Their inability to do everyday tasks based on their race follows them to work. This leads to a non-essential desire to attend work accompanied by discrimination in the workplace. For many blacks, the impact of discrimination has had a negative impact on their lives. Their race has made it harder for them to succeed with unfair treatment…
