On 09 January at approximately 0900, Angel Rodriguez reported that while in Ms. Kimberly Nelson Biology class he and another student, Alicia Gieseck became curious about two specimens that were in glass containers in the back of the classroom. Mr. Rodriguez stated that he picked up the smaller of the two jars by the lid to closer examine the specimen. He observed that the top of the jar appeared to be glue shut. He then reported that he reached over and attempted to pick-up the larger jar, only to realize the lid unsecured and Formaldehyde used to preserve the specimen spilled onto the counter and to the floor.
Mr. Rodriguez immediately sought Ms. Nelson’s attention, who at the time was sitting at her desk in the front of the classroom. As reported, Ms. Nelson instructed both students to clean up the liquid. For the record, Mr. Rodriguez asserted that Ms. Nelson did not know then that the jars contained Formaldehyde, and thought instead that they contained alcohol. Angel Rodriguez stated that they placed paper towels on top of the spillage to absorb the Formaldehyde and that it was during this time that his eyes began burning, after which he alerted Ms. Nelson. For the record, Ms. Melissa Murphy who is not a licensed nurse or certified medical personnel was substituting during the incident, as the school nurse was out of office for the day. Mr. Rodriguez stated that although he did not believe that the liquid had touched his hands, Ms. Murphy insisted that he thoroughly washed his entire hands, to which he complied. He also stated that he stayed an additional five minutes in the nurse’s office for observation and to ensure that his eyes were no longer burning. He returned to class
