There are different routes to inpatient mental health treatment in Arizona. My goal is to explore the different rationales for voluntary verses involuntary admissions and also the petition process for our state. Mental health patients treated on an inpatient basis are either admitted under a voluntary admission or an involuntary admission.
Arizona state statutes state that “Any person who is eighteen years of age or older and who manifests the capacity to give and gives informed consent may be hospitalized for evaluation, care and treatment by voluntarily …show more content…
If a parent, guardian or state custodian is unavailable after a practical effort has been made to locate them the court will then appoint a guardian for the child (treatmentadvocacycenter.org 2007). Evaluation of the prospective client is followed after informed consent is received.
Discharge of the voluntarily admitted client happens after the medical director of the mental health agency determines the client is no longer benefiting form evaluation, treatment and care on an inpatient basis. From there the county attorney will then examine the petition and make one of the following written recommendations, that a criminal investigation is warranted, that the screening agency will file the petition or that no further proceedings are warranted (treatmentadvocacycenter.org 2007). The screening agency (health care agency which is licensed by the department) will consider the recommendation in determining whether a court-ordered evaluation is justified and will include the recommendation with the petition if it is decided to proceed and file the petition with the court (treatmentadvocacycenter.org
