In this passage, for the author's argument, the author's overall stand is that he claims that capital punishment known as death punishment under the Eight Amendment should not be banned. This is due to two reasons listed below.
Firstly, the reason is because banning of capital punishment does not reflect the will of the people but the leaders. It can be seen in the passage that the decision made only reflects the leaders rather than the people. Leaders are the one who are making the decisions using the opinion polls by the state legislations. People have the nature of rights for themselves but the leaders are not applying the popular sentiments to the decisions they are going to make. However, in my own objecting to the reason, leaders are the professional bodies making decisions helping the state and they are also the leaders that are elected by the citizens. Citizens should have a trust in them on why they resort to that. My second objection to the reason is because people do not know how expensive it is to have death punishment. It gives many problems when the verdict given to criminals are clearly wrong, as it can be seen in Kris Maharaj case where his death sentences was overturned and he is still serving life imprisonment for a crime he did not commit in Florida. Those who have an ineffective counsel will be affected by the "Procedural bar" concept where have future problems appealing sentence and convictions at early stages. Cutting corners can affect the criminal justice system dangerously that can lead to wrongful verdict, and executions in capital cases. My objecting to this reason is wrongful convictions such as corruption of people involved in solving the criminals' cases eyewitness identifies wrong person, false confessions, ineffective counsel, informants and human error will occur very easily that spoil real justice by killing innocent people. 2013 Global Corruption Barometer found out that more than one quarter of people around the world accept bribery and majority of the people surveyed and said that their governments fighting corruption ways are ineffective (Bidwell, 2013). Eyewitness mistakenly identification is the most common cause happening in the United States today. Defendants of accused may give wrong confession that may cause by the stress from the police and many more. Accused may have financial problem paying legal fees and higher chances to lose to prosecutor or plaintiff. Informants are people that cannot see light, thus they will have difficulties coming to court to defend for the accused or may even make up the evidences. Prosecuting attorneys also known as justices will make human error due to misjudgments in verdict and may killed an innocent people (Blankinship). This will violates human dignity of killing innocent people with wrong verdict with death punishment existing.
