Wiley decided not to disclose his citation when given the “Statement of Arrests and Convictions” form. We again, put ourselves in someone else’s shoes, this time being the OMP. We came up with three possible alternatives for this part. The OMP can deal with the situation with an open mind and ask Wiley why he didn’t disclose of the matter in the first place. He could treat this as a strike against Wiley and tell him to make sure he discloses information upfront, and if not sure whether to disclose or not, ask. Lastly, the OMP could terminate Wiley’s employment. We decided as the OMP, we would deal with the situation with an open mind and ask Wiley about the incident. The OMP does know how Wiley performed during his internship and offered Wiley the position after graduation. He had impressed superiors and co-workers during his internship. He had strong technical and interpersonal skills and always conducted himself in a professional and ethical manner, as indicated by his performance review. After thorough consideration of his performance and discussion with Wiley, we would disclose future consequences in the event of future incidents. To start with, Sally does not know how Wiley will answer the “Statements of Arrests and Convictions” form. She must take into consideration how it will reflect upon her if she notifies the OMP and Wiley did decide to disclose the matter. We don’t feel Sally has a moral or ethical responsibility to inform the OPM for the incident at hand. We believe Wiley’s incident is a personal matter and his personal decision whether to disclose or not, is his choice. However, this is our conclusion solely for this incident. We do believe if the offense were more business-related to Wiley’s employment, this would be a moral or ethical responsibility of Sally’s to inform the OPM. In the event of a business-related incident, Sally’s disclosure would only be for the benefit of the company and not to spite Wiley. If he did not decide to reveal a business-related incident, Sally would be reporting an important issue in much need of revelation. If he did decide to disclose a more business-related incident, Sally’s concern for the matter is sincerity for the company. For the minor-in-possession citation, it is not Sally’s moral or ethical responsibility to take the matter into her own
