Wiley decided not to disclose his citation when given the “Statement of Arrests and Convictions” form. We again, put ourselves in someone else’s shoes, this time being the OMP. We came up with three possible alternatives for this part. The OMP can deal with the situation with an open mind and ask Wiley why he didn’t disclose of the matter in the first place. He could treat this as a strike against Wiley and tell him to make sure he discloses information upfront, and if not sure whether to disclose or not, ask. Lastly, the OMP could terminate Wiley’s employment. We decided as the OMP, we would deal with the situation with an open mind and ask Wiley about the incident. The OMP does know how Wiley performed during his internship and offered Wiley the position after graduation. He had impressed superiors and co-workers during his internship. He had strong technical and interpersonal skills and always conducted himself in a professional and ethical manner, as indicated by his performance review. After thorough consideration of his performance and discussion with Wiley, we would disclose future consequences in the event of future incidents. We would not discipline Wiley for his first offense, rather forgive but not …show more content…
To start with, Sally does not know how Wiley will answer the “Statements of Arrests and Convictions” form. She must take into consideration how it will reflect upon her if she notifies the OMP and Wiley did decide to disclose the matter. We don’t feel Sally has a moral or ethical responsibility to inform the OPM for the incident at hand. We believe Wiley’s incident is a personal matter and his personal decision whether to disclose or not, is his choice. However, this is our conclusion solely for this incident. We do believe if the offense were more business-related to Wiley’s employment, this would be a moral or ethical responsibility of Sally’s to inform the OPM. In the event of a business-related incident, Sally’s disclosure would only be for the benefit of the company and not to spite Wiley. If he did not decide to reveal a business-related incident, Sally would be reporting an important issue in much need of revelation. If he did decide to disclose a more business-related incident, Sally’s concern for the matter is sincerity for the company. For the minor-in-possession citation, it is not Sally’s moral or ethical responsibility to take the matter into her own

The first function of the probation or parole work is the presentence investigation. This investigation delves into all aspects of the offender’s background. The information is gathered to provide a sentencing decision. The legal information that is provided in the report includes any juvenile or adult record that the offender has and would include probation history if any. The official version of the offense that has been committed is included and any plea bargain information. If there are any pending cases against the offender is also included. The other information that is included in the presentence investigation is the probation officers recommendations, whether the offender has any gang affiliations, any background or ties to the community. The offender’s substance abuse history, physical and mental health history, financial and employment circumstances, and education history are covered. And lastly, the victim’s impact statement is included along with any marital or military history. Then the probation/parole officer evaluates and summarizes all this information. There tends to be more extralegal information contained in…

The three issues that I feel could compromise one’s credibility are; 1) not following the law of conduct on or off duty, 2) over achieving their power that they are authorized to use and 3) not being courteous and respecting the offenders. In order to keep these issues from becoming a pitfall into a probation officers profession is when he or she is off duty they need to keep their personal life personal because they are entitled to a personal life. It is how they conduct themselves when in the public. Example: Sally June is invited to a house party at Cheryl’s house once Sally arrive there she know what her profession is and the people that are going to be there is the public.…

When criminals are arrested and about to be tried in front of a jury of their peers and a judge, they are most likely will be offered a plea deal. Now this plea deal if it is accepted by the offender will stand as their punishment for the crime committed without having to go through court and trial which in some cases helps to spare the victims from having to testify in front of the person that had wronged them. Rape victims are the ones that are the most beneficial from plea bargaining, they do not have to face the offender that brought them such harm. On another note though these offenders are not serving the time that they would originally be given if gone to trial so the victims feel as though there is an injustice to plea bargaining. People that are harmed want their offenders to serve the most time they can so that they are given time to heal and recover from these inhumane acts of committed against them. “The Bureau of Justice Statistics, after studying partial data on state-court felony prosecutions nationwide, found that from 1986 to 2006 the ratio of pleas to trials nearly doubled.” (Oppel, 2011)…

    6. “‘Well, of course law informant should be stopping, searching, and frisk him. Of course they should be keeping an eyes on him, he is a drug felon.’ And we knew we couldn’t put a criminal on the stand because they would be inevitable cross examine in front of a jury about their prior criminal history, their whole credibility would be challenged. Fred is drunk and driving his dad’s car. Fred is a 21 year old student at Columbia College. Fred rams into a parked car at 10th and Rogers. Thinking no one saw him; Fred moves his car and parks it on an adjacent lot. He sprints to his dorm room in Miller Hall. A neighbor saw the wreck and Fred running to the dorm. Police are called and they arrive ten minutes after the wreck. The officers see several empty beer cans and a bottle of tequila (half full) in the front seat. The tags are traced to Fred’s dad, who is called by police. Dad says that Fred is a student at Columbia College. Police run Fred's record and determine that he has two prior DWIs within the past five years. The third DWI in 10 years is a felony. Police contact Columbia College security who leads them to Fred’s dorm. Fred is passed out, so security lets them in. The officers smell intoxicants, give Fred some Field Sobriety tests (he fails) and confirm that he was driving the car. Fred is arrested for DWI. It is his third offense, a felony under Missouri law. Fred is given a breath test, which registers at .13 on the scale. During the processing of his arrest paperwork, the officers search Fred’s possessions which he brought to the station, and a small quantity of cocaine is found in Fred’s pocket. Fred is charged with DWI, leaving the scene, and possession of cocaine. What issues do you see? How should they be resolved? (50 points)…

Hypothetically, I am applying at local police after completing the police academy. One friend of mine from college actually work for the same department. However, she decided not to mention the fact that we were arrested for marijuana our freshman year, reason being is that the charges were dropped because the search the officers ducted was illegal. She also advised me that the department does not conduct polygraph as part of the hiring process. I now have the decision to either lie on the form or tell the truth about the incident. I know if that if I lie eventually I will be found out, but I believe that the long-ago arrest will never become known. If I don’t lie, I will be asked to explain the situation of the arrest and my friend will be implicated in the story.…
