First, society has an interest in protecting kids (especially those in the audience) from lewd , vulgar , and sexually explicit speech. Also, schools have a duty to teach student speakers the “habits and manners of civility” essential to democratic governance. Schools must teach students to responsibly consider the sensibilities of others, even when exercising their right to express unpopular viewpoints. Schools may reasonably conclude the boundaries of socially appropriate behavior cannot adequately be taught to students in an environment where the right to communicate in lewd, vulgar, and sexually explicit terms are absolute. Therefore, schools can constitutionally punish students for vulgar and lewd speech inconsistent with their educational…
Schools may regulate student speech that results in a material and substantial disruption within the school. Tinker v. Des Moines Indep. Cmty. Sch. Dist., 393 U.S. 503, 509, 513 (1969). Garner Vo-Tech must show either that there was an actual disruption within the school or that officials reasonably anticipated a material and substantial disruption was likely to occur. Alternatively, the Court could expand the exception found in Morse that waives the disruption requirement and include speech that calls for the bullying and harassment of a specific student. Morse v. Fredrick, 551 U.S. 393, 407 (2007).…
Flannery O’Connor’s A Good Man is Hard to Find follows a peculiar Grandmother as a string of events she is responsible for eventually lead to the death of her loved ones and herself. First and foremost, the grandmother, a manipulative and self-interested lady with no intention of compromising, suggests the family take their vacation through Tennessee rather than Florida, partly in an attempt to avoid a so-called Misfit who appears to be “aloose from the Federal Pen” (3) in Florida. Unfortunately, the Misfit is actually in Tennessee, and thus begins the implausible sequence of events peaking in the murder of the grandmother’s family.…
Children’s lives are changed by bullies every year all over the world, especially for Jamie Nabozny, a student in Ashland, Wisconsin. He was homosexual from a young age and constantly got bullied because of it. Every day at school, he would be bullied verbally and physically. After one ruthless attack, he was hospitalized and had surgery. He had been studying when one of the bullies walked up to him, kicked the books out of his hand, and kept on kicking him. Once he was finished, he leaned down and whispered in Jamie’s ear, “If you tell anyone, I’ll kill you.” This put Jamie over the line and he decided to act. He brought it to court trying to sue the school district for not protecting him. Bullying kids is harmful to the bully and the kid you’re bullying because it can get the bully into deep trouble and can leave the kid different for life.…
Silvergate notes that limiting free speech would fall to the responsibility of college administrators who will undoubtedly over censor due to the broad harassment regulations the proposed bill contains. He supports this point by adding that the Individual Rights Foundation, FIRE already claims harassment as “the most abused tool to limit free speech.”…
The first amendment states that only if a person’s speech has substantial interference with school discipline or the rights of others it may be censored. Most people take that how it is supposed to be taken. If you actually read the law, it is easy to see that many things…
This bill could potentially effect the funding and resources the school gets from California as well as surrounding states. Such resources could include gas, food supply, water, etc. If there is a shortage of those resources the state could be placed in a state of emergency in some sections or even the entire state. If this happens then education…
The Amendment states that “Congress cannot make laws that violate Americans' basic freedoms, including freedom of speech”. Social Studies Alive, 317. This shows that the government provides individuals with the right not to be censored if it is appropriate and not disruptive. “The First Amendment protects citizens’ rights to speak out against the government. These students are exercising their right of freedom of speech as the Supreme Court considers a case involving freedom of speech in schools.”…
“Women, sexual assault victims, people of color, transgender students. College campuses have created “safe spaces” for all sorts of marginalized groups. But in the process, one member of the campus community has lost precious real estate. Free speech” (1). This quote from the article “Free Speech is Flunking Out on College Campuses” by Catherine Rampell introduces the idea that the right to freedom of speech is being squashed. All over the country, colleges are taking away this right from their students in order to protect others, but in reality, they are only stripping them of what is protected under the Constitution. Censorship has spread to social media apps causing students to be in constant danger of being accused of harassment. Claims…
Unless society takes affirmative action on bullying and harassment thousands of silent victims will continue to suffer. Bullying and harassment among teens around the world is a serious issue that needs to be fixed. In the U.S. teens are having trouble finding a reason to go to school if they are constantly being bullied. All teens ranging from 13 to 19 years of age in danger of being targeted by bullies and harassers. At Madera High School, on a scale from 1 to 10 on how bad bullying is at the school, it is about a 6. The issue of bullying at Madera High School is not too good, but not too bad. Madera High has a zero tolerance on bullying on and off of school grounds if it affects on of it’s students. The school’s policy does not allow any…
There is a fine line in what is considered freedom of speech and what impedes on another person’s freedom. In fact John Stuart Mill states in his book On Liberty, “the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others” (1978, 9). The use of hate speech has a strong impact, especially in minority groups where the support system is not very strong. One example hate speech being persecuted is in an article from the website Grapevine titled Ten Charged with Hate Speech Towards LGBT Community. While some individuals may argue that the freedom of speech is the right of all Americans, there are definitely limits when it comes to the hatred and harassment of a particular group. The law enacted which included sexual orientation in the group where hate speech is not allowed stemmed from the fact that the suicide rate for LGBT teens is much higher than it is for other teens. The Trevor project found LGBT teens are 4 times more likely to attempt…
When America was created, it was supposed to be a place where people could have rights such as freedom of speech and press. Freedom of speech means that citizens have the right to say and think whatever they want. Freedom of press allows citizens to write down and publish their thoughts no matter how contradictory they are. Schools around America have contradicted this freedom by banning…
Modern day students have found a new way to harass others through social media sites and electronics. Cyber bullying is on the rise and school administrators are having a difficult time creating a safe learning environment for all students without infringing upon first amendment rights. School officials now have to ask themselves when it is appropriate to punish students for behavior outside of class. All school systems should have the power to override a student’s freedom of speech if that student causes substantial disruption of the school environment.…
Bullying is a serious issue in the United States, It goes from many things like saying it behind their backs, shouting names as they walk by, to social media, also called cyber bullying. When someone is bullied it makes them feel like they aren’t worth anything and cause’s them to think everybody is better off with you dead. In the article “ Bullied Teen: 'I Had So Much Pain Inside Of Me '” says "It was very upsetting and painful," she said. "I had no idea that the bullying and torment would last six years and total 22 kids, both boys and girls, harassing Jamie on a daily basis." She added, "I didn 't realize how the whole house would be turned upside down because of little kids. I didn 't realize that our health would later become compromised due to the daily abuse and stress."(Flinn, http://riverhead.patch.com/articles/bullied-teen-i-had-so-much-pain-inside-of-me). Bullying is also physical. When physically bullying someone or being physically bullied, it has such a bigger consequence, outrage, and force behind. "In third grade, this girl told another friend of mine that if she didn 't hurt me, that she would be hurt instead. The girl told me what the bully was doing and we told the teacher and the principal, but nothing was done to reprimand this girl." The girl, Jamie said.…
Cyberbullying can also lead to kids getting physically injured. This bill ensures that someone is held accountable for the behavior that led to someone getting hurt. And by passing the Prevention Act, we’re deterring people from engaging in cyberbullying by showing such behavior is a punishable crime that won’t be…
