Was it a parody, parody of the author or satire? Determining this is going to be one of the biggest pieces to the case. If her piece were a parody then the case would be dropped and the charges would be lifted. A parody is a humorously exaggerated imitation of a serious piece of literature or writing. Over the years, parodies have been various artists that use this in order to express themselves creatively about a matter that us important to them. It is clear to see that this is not a parody because it has no purpose or provides a comedic effect. It is also not a parody of the author because she in not mocking you as a writer. Nor does she make any reference to your work as a writer. Does the reproduction of the piece have an effect upon the potential market? One of Ms. Blum’s arguments could be that she is not making any profit from the poem. It is set up in a blog form, which can be considered to be freedom of expression. Although she is not making any profit form this, she will affect sales rates. To the readers it does not matter who wrote the poem first, it is which one are they more inclined to see first. Which mean is some one was to see the blog post first, they may think that is the original piece of writing. This would cause some of the readers to not even bother to look at something that they believe may have been a copy from the original. Which ultimately would leave sale drops in the book.
